Attorney General Jackley Joins AG Coalition to Support
Federal Rule Promoting Transparency in Prescription Drug Pricing
PIERRE, S.D. – South Dakota Attorney General Marty Jackley joins a coalition of 45 Attorneys General in sending a comment letter that supports a proposed U.S. Department of Labor rule that would require greater transparency from pharmacy benefit managers (PBMs) that service employer-funded health plans covered under the Employee Retirement Income Security Act of 1974 (ERISA).
“This rule demands better transparency of pharmacy benefit managers,” said Attorney General Jackley. “Employers have a right to know how the insurance coverage they provide their employees are impacted by the decisions of pharmacy benefit managers.”
Approximately 136 million Americans receive health coverage through an employer — either their own job or a family member, The Department of Labor’s proposed rule addresses concerns that employers often lack visibility into how PBMs make money or why drug costs change. The law would require PBMs to disclose twice a year how they generate revenue and would give employers the right to audit them.
