DISCHARGING FIREARMS ILLEGAL ON INUNDATED PRIVATE PROPERTY

PIERRE – South Dakota hunters are reminded that a new state law prohibits the discharge of a firearm within 660 feet of an occupied dwelling, church, schoolhouse or livestock while on public waters that inundate private property. The law exempts the landowner and any person receiving permission from the landowner.

"This law is similar to the current 660' right-of-way safety zone law," said Law Enforcement Specialist Dave McCrea. "Overall, the law creates a 660' safety zone for hunting public waters that inundate private land, and hunters should be aware of their location and action when hunting private lands that are under water."
